Although this Bill has great significance for the protection of all Australians due to medical conscription the basis for this Bill should be based on section 51(xxiiiA) of the Constitution in respect of being civilly conscripted to accept a medical service against ones will. The High Court has spoken on this subject in the Wong v Commonwealth case and Justice Kirby interpreted 51(xxiiiA) as a Constitutional guarantee not just for medical practitioners but for the recipients of those services.
