IMPERIAL ACTS OF CONSTITUTIONAL SIGNIFICANCE IN SOUTH AUSTRALIA

Unlike three eastern States that have Imperial Acts Application legislation, South Australia does not have any such an Act. The interstate legislation identifies which Imperial Acts apply and which parts of the Acts apply; in the case of the Victorian statute the text of the relevant provisons is helpfully included. South Australia lacks these advantages. This poses the question of how lawyers and judges in this State are to ascertain which Imperial Acts still apply in South Australia.
